BMN Growth provides fixed-fee recruitment services, including sourcing, screening, and delivering a specified number of candidate profiles per month to the Client
- The Client agrees to pay the monthly fee as stated in the proposal or service agreement.
- Payments are due in advance unless otherwise agreed in writing.
- All fees are exclusive of VAT (if applicable) unless otherwise stated.
- Late payments may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
- The Client must provide accurate and up-to-date job descriptions, salary details, and any other relevant information to enable BMN Growth to provide its services.
- The Client must provide timely feedback on candidates supplied.
- BMN Growth will use reasonable care and skill to deliver the agreed number of candidate profiles per month.
- BMN Growth does not guarantee that candidates will accept offers of employment or remain employed for a particular period of time.
- BMN Growth shall not be liable for any loss of profits, business, or indirect or consequential loss arising out of or in connection with its services.
- BMN Growth's total liability in any 12-month period shall not exceed the total fees paid by the Client in that period.
- Either party may terminate this agreement by giving 30 days' written notice after the minimum term (if applicable).
- BMN Growth reserves the right to suspend or terminate services if payments are overdue.
- Fees are non-refundable once services have commenced unless BMN Growth fails to deliver any candidates in a given month.
- Both parties agree to keep all information shared in connection with the services confidential, except where disclosure is required by law.
These Terms of Service shall be governed by and construed in accordance with the laws of Scotland, and any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
These Terms, together with any proposal or service agreement, constitute the entire agreement between BMN Growth and the Client.
